1. Who these terms apply to
TAN FIT is an Australian digital platform serving schools internationally for physical education, learning, and performance activities. These Terms of Use apply when you access or use tanfit.org, the TAN FIT web application, and related services (together, the Service).
In these terms, TAN FIT, we, us, and our mean TAN FIT. School means the school, department, or other organisation that authorises your access. you means an authorised teacher, staff member, student, parent/guardian, or other user.
2. Acceptance and school authority
By creating an account, accessing the Service, or selecting an acceptance control, you agree to these terms. If you use TAN FIT on behalf of a School, you confirm that you are authorised to do so and to bind that School to these terms. Students use TAN FIT only under the School’s authority and policies; the School is responsible for obtaining any permissions required for student use.
These terms apply alongside any signed agreement between TAN FIT and a School. If a signed agreement says something different, that agreement takes priority to the extent of the difference.
3. Accounts and access
Accounts are personal. Keep your sign-in details confidential, use accurate information, and notify your School promptly if you suspect unauthorised access. Schools and authorised staff control who receives access, the role assigned to an account, and the learning or performance activities made available to students. Do not share accounts, use another person’s account, or attempt to access information outside your authorised role.
4. Permitted use
You may use the Service only for legitimate school, learning, teaching, and approved performance purposes. You must not:
- break the law, School policies, or another person’s rights;
- upload harmful code, interfere with the Service, probe security, or bypass access controls;
- copy, redistribute, sell, scrape, reverse engineer, or commercially exploit the Service or its content except where law permits it;
- submit content that is unlawful, abusive, discriminatory, sexually explicit, or infringes privacy or intellectual-property rights; or
- use TAN FIT data to make a high-impact decision about a student without appropriate human review and the School’s own processes.
5. Content and intellectual property
TAN FIT and its licensors own the Service, software, branding, templates, and other material we provide. Subject to these terms, we grant authorised users a limited, non-transferable, revocable right to use that material through the Service. You retain ownership of content you or your School provide, including activity plans, notes, assessments, and uploads. You give TAN FIT only the permission needed to host, process, display, protect, and support that content for the Service and as directed by the School.
6. Connected devices and wellbeing information
Some TAN FIT features may let a user choose to import activity or wearable-device information, such as workout, step, heart-rate, or sleep metrics. These features are optional. TAN FIT is not a medical service and does not provide medical, health, training, or safety advice. Users should stop activity and seek qualified advice where appropriate; Schools remain responsible for supervision, safeguarding, and their own health and safety procedures.
7. Availability, changes, and support
We work to keep the Service available and secure, but it may be interrupted for maintenance, updates, third-party outages, or events outside our reasonable control. We may change, add, or retire features to improve the Service, meet legal or security requirements, or support Schools. We will give reasonable notice where a material change is practicable.
8. Suspension and termination
A School may remove access at any time. We may suspend or limit access where reasonably necessary to protect users, investigate misuse, comply with law, protect the Service, or enforce these terms. On termination, access ends and information will be handled in line with the School’s instructions, applicable law, and our Privacy Policy.
9. Third-party services
The Service may work with third-party platforms or devices selected by a School or user. Their services are governed by their own terms and privacy notices. TAN FIT is not responsible for third-party services, content, availability, or practices.
10. International use
The Service is designed for Schools in different countries. You are responsible for ensuring that your use of the Service complies with the laws, education requirements, consent rules, and safeguarding obligations that apply to your School and users. TAN FIT may process information in more than one country as described in our Privacy Policy.
11. Liability
Nothing in these terms excludes, restricts, or modifies rights or remedies that cannot lawfully be excluded under applicable law. To the extent permitted by law, TAN FIT is not liable for indirect, incidental, special, consequential, or loss-of-data damages arising from use of, or inability to use, the Service. The Service is provided for educational and performance support, not as a guarantee of a particular educational, sporting, health, or other outcome.
12. Changes to these terms
We may update these terms from time to time. The updated version will be posted here with a revised “Last updated” date. If a change materially affects a School’s use of the Service, we will use reasonable efforts to notify the School’s nominated contact before it takes effect. Continued use after the effective date means acceptance of the updated terms.
